Fines & Penalties

No fine or penalty shall be imposed upon any individual or organization providing emergency food, emergency assistance and comfort, and/or emergency temporary shelter to any individual(s) who is not yet enrolled in The Freedom Smart Card System.

For each illegal worker employed, it shall be a misdemeanor, punishable by a mandatory fine of $5,000 for the first offense and $10,000 for each subsequent offense for any employer, business, or household, who hires, engages or otherwise employs an individual without verification of that person’s status through The Freedom Smart Card System. The fine shall be levied against the individual committing the offense on behalf of the employer, business or household and against all owners, operators, and/or board of directors, jointly and severally, of the business or operation.

For each unit or property, it shall be a misdemeanor, punishable by a mandatory fine of $5,000 for the first offense and $10,000 for each subsequent offense for any landlord, business, Homeowners Association or property owner, who leases, rents, or permits the occupancy or sublet of any unit or space to any individual(s) without verification of that person’s status through The Freedom Smart Card System. The fine shall be levied against the individual committing the offense on behalf of the landlord, business or property owner and against all owners, operators, and/or board of directors, jointly and severally, operating as a landlord, business or property owner.

For each unit or property, it shall be a misdemeanor, punishable by a mandatory fine of $5,000 for the first offense and $10,000 for each subsequent offense for any landlord or household who fails to file, or otherwise report, verification of any employee’s or worker’s status through The Freedom Smart Card System. The fine shall be levied against the individual committing the offense on behalf of the landlord, business or property owner and against all owners, operators, and/or board of directors, jointly and severally, operating as a landlord, business or property owner.

For each individual, it shall be a misdemeanor, punishable by a mandatory fine of $5,000 for the first offense and $10,000 for each subsequent offense for any healthcare facility or healthcare provider who renders services to any individual, except in life-threatening emergencies, without verification of that person’s status through The Freedom Smart Card System. The fine shall be levied against the individual committing the offense on behalf of the healthcare facility, healthcare provider and all owners, operators, and/or board of directors, jointly and severally, of the healthcare facility or healthcare provider.

For each individual, it shall be a misdemeanor, punishable by a mandatory fine of $5,000 for the first offense and $10,000 for each subsequent offense for any healthcare facility or healthcare provider who fails to file, or otherwise report, verification of any patient’s status through The Freedom Smart Card System. The fine shall be levied against the individual committing the offense on behalf of the healthcare facility, healthcare provider and all owners, operators, and/or board of directors, jointly and severally, of the healthcare facility or healthcare provider.

For each individual, it shall be a misdemeanor, punishable by a mandatory fine of $5,000 for the first offense and $10,000 for each subsequent offense for any government agency who provides services, except in life-threatening emergencies, to any applicant or current client without verification of that person’s status through The Freedom Smart Card System. The fine shall be levied against the individual committing the offense on behalf of the agency and will reduce government funding for that agency by a similar amount.

For each individual, it shall be a misdemeanor, punishable by a mandatory fine of $5,000 for the first offense, and $10,000 for each subsequent offense, for any government agency who fails to file, or otherwise report, verification of any applicant’s or current client’s status through The Freedom Smart Card System. The fine shall be levied against the individual committing the offense on behalf of the agency and will reduce government funding for that agency by a similar amount.

For each individual, it shall be a misdemeanor, punishable by a statutory fine of $5,000 for the first offense and $10,000 for each subsequent offense for any school or educational institution who provides services to any applicant or current student without verification of that person’s status through The Freedom Smart Card System. The fine shall be levied against both the individual committing the offense and the school or educational institution itself.

It shall be a misdemeanor, punishable by a mandatory fine of $5,000 for the first offense and $10,000 for each subsequent offense for any school or educational institution who fails to file, or otherwise report, verification of any applicant’s or current student’s status through The Freedom Smart Card System.

The fine shall be levied against both the individual committing the offense and the school or educational institution itself.

It shall be unlawful, punishable by a mandatory six-month imprisonment for the first offense, and one-year-and-a-day imprisonment for each subsequent offense, for any non-citizen who fails to apply for, or to be in possession of, a Freedom Smart Card, within the prescribed period of time, once the program is fully implemented. Any non-citizens convicted of failure to apply for, or to possess, the Freedom Smart Card, within the prescribed period of time, once the program is fully implemented shall be deported immediately following completion of their term of incarceration.

It shall be a felony, punishable by a mandatory one-year-and-a-day sentence for any individual, business, landlord, or facility who willfully violates, interferes with, or otherwise obstructs The Freedom Smart Card System and its requirements.

Any non-citizens convicted of any act of willful violation, interference, or obstruction of The Freedom Smart Card System shall be deported immediately following completion of their term of incarceration.

It shall be recognized that the Border Smart Wall, Freedom Smart Card, The Freedom Smart Card System™ and The Freedom Smart Card System ~ A Path to Citizenship are implemented as a matter of National Security, therefore it shall be a felony, punishable by a mandatory 20-year sentence for any individual convicted of any act or attempted act to forge, duplicate, hack or otherwise tamper with the integrity of The Freedom Smart Card System. Any non-citizens convicted of any act or attempted act to forge, duplicate, hack or otherwise tamper with the integrity of The Freedom Smart Card System, shall be deported immediately, and placed on the Terrorist Watchlist, following completion of their term of incarceration.

Any individual, business, association, organization, agency, healthcare facility or healthcare provider, school or educational institution, or any other entity, found guilty of willfully failing to require verification of any individual’s status through The Freedom Smart Card System, shall lose all federal funding or reimbursement for a period of not less than one year for each offense.

Any individual, business, association, organization, agency, healthcare facility or healthcare provider, school or educational institution, or any other entity, who is found guilty of willfully failing to file, or otherwise report, verification of any individual’s status through The Freedom Smart Card System, shall lose all federal funding or reimbursement for a period of not less than one year for each offense.

Any citizen who fails to apply through The Freedom Smart Card System shall not be subject to any fine or penalty; however, at some point their access to certain privileges, rights and benefits of full citizenship will be limited.

All alien residents must register through The Freedom Smart Card System within one year, and prior to being able to access any privileges, rights, and benefits of a legal alien resident. Failure to register through The Freedom Smart Card System within the first year of the implementation of the program will result in a fine of not less than $500 and potential deportation.

All illegal aliens, with current residentcy, and with 2 or more family members, must register through The Freedom Smart Card System within 90 days, and prior to being able to access any privileges and benefits. Failure to register through The Freedom Smart Card System™ within the 90 days of the implementation of the program will result in a fine of not less than $1,500 per individual and potential deportation.

All alien visitors in possession of current and valid tourist visas, with a remaining term of more than 90 days, must register through The Freedom Smart Card System within 30 days. Failure to register through The Freedom Smart Card System, within 30 days of the implementation of the program, will result in a fine of not less than $1,500 and potential future ban against entry into the United States.

Any individual, whose case is pending a hearing, under review, or pending an appeal, shall be provided with a 30-day temporary Freedom Smart Card, clearly marked as to the date it will expire, and containing all the other protections, safeguards and physical characteristics of a permanent Freedom Smart Card. This card may be renewed for a one-time 30 day extension period or be replaced with a permanent Freedom Smart Card, or the individual must be deported forthwith.
